Chat4buy terms and conditions

SWISS TBF AG (“CHAT4BUY”) offers you the possibility of using the following ” CHAT4BUY ” services (“Services”)*:

а) CHAT4BUY: choose the fastest and easiest refund method for the items you want to return. Use the virtual credit obtained for your next orders.

  1. b) Première: save your searches while shopping and stay updated on new arrivals of the items that interest you most
  2. c) My orders: follow the shipment of your orders, change or return items that are not for you and see the your order history.
  1. d) Dream Box: save the items you most want and keep an eye on their availability.
  2. e) My data: manage your registration data.
  3. f) My addresses: save or modify your addresses to always have them available and complete your purchases faster.
  4. g) My cards: save or modify the cards you use for your purchases and complete your orders quickly and always in a secure manner.
  1. h) My Sizes: create your profiles and only find the items in your perfect size.

2 Registration

2.1

If you want to use the Services you must be an adult user, register on CHAT4BUY.com creating your CHAT4BUY

account and accept these terms and conditions for using the services (“Conditions”). Registration is free. To create

your CHAT4BUY account, you will need to fill out the registration form by entering the required information and

guarantee to CHAT4BUY that the information provided during the registration process is complete, correct and

truthful. In particular, with regards to the uploading of photographic images (“Photos”) for use on the service

CHAT4BUY, you explicitly declare that you are the exclusive and legitimate copyright holder of all copyrights relating

to these images. CHAT4BUY shall not in any way be held liable for photos of third parties uploaded by you. We will

send you an email to confirm your registration. We remind you that the credentials to access your CHAT4BUY

account must be used exclusively by you and cannot be transferred to third parties. Notwithstanding the legal

limitations, CHAT4BUY cannot in any way be held responsible in the event that unauthorised third parties access

your CHAT4BUY account. We therefore ask you to keep your credentials confidential and to immediately inform

CHAT4BUY if you suspect that there has been unauthorised access to your CHAT4BUY account or that your

password has been violated.

2.2

It may be necessary to use electronic communication channels for the provision of some services (such as e-mail,

SMS or telephone). If you want to use these specific services, you will be asked to give your consent to be contacted

by CHAT4BUY for the related communications by SMS, email or other communication channel.

2.3

If you have not already done so, we also ask you to consult our General Conditions of Use which form an integral part

of these Conditions. For any other legal information, consult the General Conditions of Sale, Return Policy and

Privacy Policy of CHAT4BUY.com.

3 Duration and termination

3.1

Registration with the services will be effective from the moment you receive the confirmation email and for the entire

period in which you use the services.

3.2

You may, at any time and for any reason, cancel your subscription to the services by sending a request to our

Customer Service by selecting “privacy”. In case you have exercised the right of withdrawal, we will send you an

email to confirm the cancellation from the services.

3.3

CHAT4BUY reserves the right to cancel your registration to the services in case of violation of the provisions

contained in these Conditions, or in the event that complete, truthful and correct personal data has not been provided,

without prejudice to the right to compensation for the damage suffered. CHAT4BUY also reserves the right to

temporarily suspend, without prior notice, the provision of the services for the time necessary for technical

interventions necessary and/or appropriate to improve the quality of the services. CHAT4BUY may, at any time,

interrupt the provision of the services for security reasons.

4 Warning on the services

CHAT4BUY does its best to provide accurate services. Without prejudice to the legal limits, the services are provided

free of charge as they are (“AS IS”). CHAT4BUY does not provide any guarantee, by way of example but not limited

to, the quality, the proper functioning, the absence of interruptions or the suitability of the services for an objective or

a particular result set by the user.

5 Modification and updating

These Conditions are modified from time to time also in consideration of possible regulatory changes. The new

Conditions will be effective from the date of publication on CHAT4BUY.com. Therefore, you are requested to

regularly access this section in order to check the publication of the most recent and updated conditions.

*The availability of the services varies depending on your country. Check which services are available in your

CHAT4BUY account.

GENERAL TERMS AND CONDITIONS OF SALE

The following General Terms and Conditions of Sale govern the sale of products on our website(“CHAT4BUY.com”).

The products purchased on CHAT4BUY.com are sold directly SWISS TBF AG (the “Vendor”), company address:

Chamerstrasse 176, 6300 Zug, Switzerland. Requests for information should be made through our Customer

Care service. For further assistance, please go to our Customer Care area where you will find information on

purchases, shipping, refunds and returning products purchased on CHAT4BUY.com. Remember that you can

always contact the Vendor through Customer Care. For any other legal information, please visit the following

sections: General Terms and Conditions of Use, Privacy Policy and Return Policy.

1 Our Business Policy

1.1 The Vendor offers products for sale on CHAT4BUY.com and its e-commerce business services are available

exclusively to its adult end users, i.e. “consumers”.

1.2 “Consumer” means any individual who is acting for purposes outside of his or her trade, business or profession. If

you are not a “consumer”, please do not buy any products on CHAT4BUY.com.

1.3 The Vendor reserves the right not to accept order proposals received from users who are not “consumers”. The

order proposals sent to the Vendor and the returns made by the users must also match with normal consumer needs.

The Vendor monitors the number of order proposals and returns.

1.4 These General Terms and Conditions of Sale exclusively regulate the transmission by the users of

CHAT4BUY.com and the acceptance by the Vendor of order proposals relating to products on CHAT4BUY.com.

1.5 The General Terms and Conditions of Sale do not apply to the provision of services or the sale of products by

third parties that are present on CHAT4BUY.com via links, banners or other hypertext connections. Before sending

orders and purchasing products and services from third parties, we recommend that you verify their terms and

conditions. Under no circumstances shall the Vendor be deemed liable for the supply of third party services or for the

execution of e-commerce transactions between users of CHAT4BUY.com and third parties.

2 How to place an order, and our contract with you

2.1 To place an order proposal for one or more products on CHAT4BUY.com, you must fill out the online form and

send it electronically to the Vendor, following the relevant instructions.

2.2 Before sending your order proposal, we ask that you carefully read the General Terms and Conditions of Sale

and the Return Policy. You may wish to print a copy using the print option and keep it safe for your own personal use.

2.3 On the order confirmation page, which appears just before the completion of your order proposal, and which

contains a reference to the General Terms and Conditions of Sale and the Return Policy, we will provide you with a

summary of the main characteristics of each indicated in your order proposal, the price (including all applicable fees

and taxes), and the cost of shipping (including any additional fees you may be charged if you choose shipping that is

faster than and/or different to standard shipping).

2.4 Your order proposal is an irrevocable offer to buy the products. Before submitting the order proposal form, you will

therefore be asked to identify and correct any possible input errors.

2.5 Following placement of your order proposal, the Vendor will send you an automatic acknowledgment of receipt.

However, this does not constitute acceptance of your order proposal by the Vendor nor does a contract between you

and the Vendor exist at this point in time in respect of your order.

2.6 The Vendor’s acceptance of your order proposal will take place when the Vendor emails you to confirm that the

order has been dispatched, at which point a contract will come into existence between you and the Vendor. The

acceptance email represents an electronic purchase receipt and contains the General Terms and Conditions of Sale,

a summary of the Return Policy, and all relevant information relating to your order.

2.7 The order proposal form sent to the Vendor will be filed in our database for the time required to process it and as

stated by law. You may access your order proposal form in the My Orders section.

2.8 English is the language used for finalising the contract with the Vendor.

2.9 If the Vendor is unable to accept your order proposal for any reason (including any of the reasons described in

this section 2.9 or if a product is out of stock), the Vendor will inform you of this. The Vendor is also entitled to reject

your order proposalin the following circumstances: the Vendor has identified an obvious and unmistakeable error in

the price or description of the product; the Vendor suspects illegal or fraudulent activity; or you have not complied

with these General Terms and Conditions of Sale. If so, the Vendor will notify you as soon and require you to return

the products if they have already been delivered to you.

2.1 By submitting an order proposal form, you unconditionally accept and undertake to observe the provisions of

these General Terms and Conditions of Sale in your contract with the Vendor. Should you not agree with certain

provisions of these General Terms and Conditions of Sale, please do not submit your order proposal form for the

purchase of products on CHAT4BUY.com.

2.11 By submitting an order proposal form, you agree and accept these General Terms and Conditions of Sale as

well as further conditions contained on CHAT4BUY.com, including those accessed via links, and including

the General Terms and Conditions of Use, Privacy Policy and the Return Policy.

3 Guarantees and product price indication

3.1 The website CHAT4BUY.com top-quality products. These products are purchased by the Vendor from fashion

houses, manufacturers and dealers, carefully selected for their stringent quality control.

3.2 The Vendor does not sell second-hand products, flawed products or products of lower quality than the

corresponding market standards. Only vintage products, which are sold in a specific area on CHAT4BUY.com, may

be second hand and/or in a worn condition because of the particular nature of the product. In the description of each

vintage product, CHAT4BUY will specify the preservation conditions of the products if different from the standards set

by the market.

3.3 The main characteristics of the products are shown on each product page on CHAT4BUY.com. The images and

colours of the products displayed on CHAT4BUY.com may not correspond exactly to the true garments due to the

Internet browser or monitor used.

3.4 Prices are subject to change. Please check the final price before sending your order proposal form. In the event

of a recognizable error in the indication – by the Vendor – of the product price or calculation of the amount requested

at payment, the Vendor will not accept the order proposal and contact the user to offer them the opportunity to send

purchase order proposal for the product(s) at the correct price.

3.5 The Vendor cannot accept purchase requests from countries not listed on the splash page.

3.6 All products come with an identification tag with a disposable seal attached.

4 Payment

4.1 Payment of the price of the products and the costs of their shipping and delivery must be made using one of the

methods indicated on the order proposal form. Under no circumstances will you be charged more than the cost

incurred by the Vendor relative to the payment method chosen by you.

4.2 In the case of payment by credit/debit card, all details (for example, card number or expiration date) will be sent

via an encrypted protocol to the banks which provide remote electronic payment services to the Vendor, without third

parties having any access whatsoever thereto. These details will not be used by the Vendor except for carrying out

procedures relevant to your purchase, or issuing refunds in the case of returns, subsequent to the exercise of your

right to return, or for reporting cases of fraud on CHAT4BUY.com to the police or other authorities. The price for the

purchase of products and the costs for their shipping and delivery as indicated on the order proposal form will be

charged to your account at the moment in which the purchased products are shipped.

5 Value vouchers

5.1 Value vouchers are personalised codes, also referred to as CHAT4BUY, which allow you to take advantage of a

discount on your purchase on CHAT4BUY.com.

5.2 The CHAT4BUY box is displayed on the first page of the Checkout: after you have inserted your items in the

Shopping Bag and entered your code, press New Total. In the pop-up window, you will need to select the item to

which you wish to apply your voucher. Select the item and press APPLY. Value vouchers can be used only on a

single item from your order proposal, therefore any other item inserted in the Shopping Bag will not receive a

discount.

5.3 Restrictions to the use of value vouchers:

– The value voucher can be used only once, with the exception of returns (as specified in paragraph 5.4);

– The value voucher cannot under any circumstances be exchanged for money;

– You may not use more than one value voucher per order proposal;

– The value voucher can be applied only to one item per order proposal;

– The value voucher can be applied only to items with a higher value than the voucher itself;

– The value voucher cannot be applied to any Sample Sale or Charity Sale items.

5.4 If for any reason you wish to return the item to which you applied the value voucher, you should follow the

standard return procedure, as described in the Return Policy. Once your return has been accepted, you may request

the reactivation of the code with its original value. The difference in price between the value voucher and the item you

purchased will be reimbursed, according to the time frame of the applicable refund procedure.

of Sale.

10 Governing law and dispute resolution

10.1 These General Terms and Conditions of Sale (including the Return Policy), their subject matter and formation,

are governed by English law.

10.2 In the event of a dispute between the Vendor and you arising from the General Terms and Conditions of Sale

(including the Return Policy), you and we both agree that the courts of Switzerland.

10.3 Please note that the European Commission also provides a platform for alternative out-of-court resolution of

disputes, available on the website http://ec.europa.eu/odr.

11 Amendments and updates

The General Terms and Conditions of Sale (including the Returns Policy) may be amended from time to time. Any

changes are effective as of the date of publication on CHAT4BUY.com and will apply to any new orders you place

following the date of publication.

RETURN POLICY

As a consumer, you have legal rights to:

  • Change your mind and withdraw from the sale contract with SWISS TBF AG (the “Vendor”) for any reason and

without incurring any penalty within fourteen (14) days from the date on which you (or someone you nominate)

received the products purchased from CHAT4BUY.com. See section 1 below, including the exceptions to this right;

or

  • reject product(s) in certain circumstances, for example because they are faulty or not as described. If so, you shall

notify the Vendor within thirty (30) days of receipt using the online Return Form on the website; if a product becomes

faulty after the thirty (30) days please contact Customer Care before returning any product to us.

1 Right of withdrawal

You can exercise your right to withdraw from a contract between you and the Vendor within fourteen (14) days from

the date on which you (or someone you nominate) receives the relevant product(s) by using one of the following

methods:

  1. a) Online submission to the Vendor of the Return Form found in the Customer Care area, completed in its entirety; in

this instance, the Vendor will send you an e-mail confirming that the Vendor has received your return request.

  1. b) Sending to the Vendor this form – to be completed in its entirety. This form must be submitted by Customer Care

by email or by post SWISS TBF AG, Chamerstrasse 176, 6300 Zug, Switzerland.

(c) Make any other clear statement to the Vendor setting out your decision to withdraw from the contract.

Once you have exercised your right to withdraw from the sale contract, you must return the products to the Vendor

without undue delay and in any event not later than fourteen (14) days after the day on which you notified the Vendor

of your decision to withdraw. Please see section 2 below for details of your return options.

By law, it is not possible to exchange the chosen product(s) for other product(s). However, if you request an

exchange, we may exchange the product(s) you have returned for alternative product(s) that you have requested, on

a goodwill basis and in accordance with our Exchange Policy which is set out in section 5 below.

Your right to change your mind and withdraw from a sales contract does not apply in respect of customised or

personalised products, or items that were opened or unsealed after delivery and that cannot be returned for health or

hygiene reasons.

2 Procedure for returning products to the Vendor

The Vendor recommends you use the courier (courier) for returning products. If you use UPS and the pre-printed

label – which carries the return address – enclosed in the original order, you will not have to pay the return costs

upfront. The Vendor will pay the courier (courier) on your behalf and (except where you are exercising your legal

rights to reject products – for example because they are faulty or not as described) will deduct from your refund a fee

which is equal to the cost incurred for delivering the purchased products to your home. Contact (courier) to organise a

return. The possibility of tracking each package sent at any time using this shipping method relieves you from any

responsibility for loss or damage to the products during transit.

If you decide to return products using a courier other than (courier), you will have to pay the return shipping costs

upfront. In this event, you will also be refunded an amount equal to the standard shipping cost of the purchased

products although you will not be refunded for any additional costs incurred due to choosing another kind of shipment

and delivery that is different to or faster than the standard method.

3 Compliance checks for returned product(s)

You will be notified if the returned product(s) cannot be accepted because they are not compliant with the conditions

indicated above. If so, you can choose, at your own expense, to have the product(s) returned to you. If you do not

wish to have the product(s) returned to you, the Vendor shall retain the product(s) and the amount paid for the

purchase of the product(s).

All products must be returned in a new and unused state, in perfect condition, with all protective materials in place

and tags and stickers attached to them (if applicable), including all packaging, accessories and documents. The

Vendor reserves the right not to accept any return if the product shows signs of wear or has been used or altered

from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or

exchange accordingly.

For example the Vendor may make a reduction in the following circumstances:

  • the product(s) have been used, worn, damaged or washed;
  • the identification tag with the disposable seal is not attached to the product(s) or has not been returned. Please

note that identification tag constitutes an integral part of each product; and/or

  • you have not returned any packaging which is an integral part of a product (such as a dust bag).

You will be informed if the Vendor proposes to reduce your refund for this reason. In this instance, you may (as an

alternative to the Vendor providing you with a reduced refund) choose to have the products sent back to you at your

own expense.

The Vendor does not assume any responsibility for items returned by mistake or items not related to the return left in

the packaging or in the returned items.

4 Refund times and procedures

If you are entitled to return product(s) to the Vendor and have complied with the conditions set out in this Return

Policy, you will receive an e-mail confirming that the return has been accepted (which will include the amount of

refund due) and the Vendor will process the refund. The refunded amount will be the full amount you paid for the

relevant product(s), subject to any deductions in accordance with section 2

Whatever the form of payment used, the Vendor will process the refund as quickly as possible and, in any case,

within fourteen (14) days from the date it was informed of your decision to exercise your right to return, and once it

has checked that the return was carried out in compliance with the above conditions.

The time period for refunding the amount paid for purchasing the returned products depends on the form of payment

used:

  • Purchase by credit/debit card: refund time will depend on the card company, but will normally take place within two

billing cycles. The credit’s value date will be the same as the original debit. You will not, therefore, suffer any losses in

terms of bank interest.

  • Payment by PayPal: refunds will be credited to your PayPal account and will be visible immediately. The actual

reimbursement of the credit card associated with your PayPal account will depend on the company that issued the

card.

  • Payment made by cash on delivery (if available): we will refund to the bank account indicated by you, so the time

taken for the refund will depend on the accuracy of the information provided by you; the refund will usually take

fourteen (14) days.

In the case of gifts, the refund of the sums paid for purchases will be made to the individual who made the payment.

As an alternative to receiving a refund on your Credit/Debit Card, PayPal account or your Bank Account, you can

choose to receive a credit (“CHAT4BUY “) to your online CHAT4BUY account equal to the value of the refund that

you are entitled to.

If you want to receive CHAT4BUY instead of having your Credit/Debit Card, PayPal or Bank Account refunded, you

must select the corresponding box on the Return Form. The refund amount will be credited when the Vendor accepts

your return. Upon issue of CHAT4BUY you will receive a confirmation e-mail indicating the store credit amount. The

CHAT4BUY will be used partially or in full towards purchases on CHAT4BUY.com based on the order’s value and

until the store credit is used up.

To find out how much CHAT4BUY you have, consult CHAT4BUY. You can also request full reimbursement of your

CHAT4BUY, and we will credit the amount by bank transfer or to your PayPal account. Receiving a refund in the form

of CHAT4BUY is non-transferrable and is available only to CHAT4BUY registered users.

If you return items paid in full with CHAT4BUY, you will automatically be refunded with CHAT4BUY when those

returned items are accepted. If you return items partially paid with CHAT4BUY, you may choose to:

– receive a full refund with CHAT4BUY

– receive a partial refund with CHAT4BUY for the amount paid with CHAT4BUY, and the standard refund procedure

for the remaining amount.

The Vendor will process the full reimbursement of your CHAT4BUY within 48 hours of receiving your request. The

Vendor shall not be responsible in the event of incomplete or wrong bank information.

After using part or asking for a complete refund of your CHAT4BUY, you can consult the corresponding CHAT4BUY

section to check how much CHAT4BUY you have left or that the total reimbursement took place.

CHAT4BUY issue and use: choosing a refund in the form of CHAT4BUY is available only to CHAT4BUY registered

customers and in relation to returned merchandise that has been paid for.

CHAT4BUY cannot be used together with Value Vouchers.

5 Exchange Policy

In certain circumstances detailed below, you shall be entitled to exchange your product for a different size or colour of

the same product type. Exchanges are subject to product availability at our warehouse. You can request an

exchange using the online Return Form on the website, which allows you to exchange your purchased product using

the options available.

The request for an exchange of the product is subject to the following conditions:

  • product exchange shall only apply to purchased products for which this possibility is expressly specified on the

online Return Form on our website by means of the word “EXCHANGE” being indicated;

  • you may only request the replacement of one or more purchased products with products of the same type, but in a

different size and/or colour. The available replacement options will be indicated in the online Return Form;

  • you may request to exchange one or more purchased products within and not later than 14 (fourteen) calendar

days of the day you receive the products, by filling in the Return Form online within such deadline. You must return

the products to be replaced to the Vendor within 14 (fourteen) calendar days of the day you notified the Vendor of

your decision to exchange the products. Please see sections 1 and 2 above for details of how to return product(s) to

the Vendor;

  • you may only submit a single replacement request for each product purchased;
  • the product(s) for which you request the replacement must be returned to the Vendor with all packaging which is an

integral part of the product(s) (such as a dust bag), they must not have been used, worn, washed, modified or

damaged, and they must still have their identification tag attached with the disposable seal;

  • the products to be exchanged that are part of a single order must be returned to the Vendor in a single shipment.

The Vendor reserves the right to refuse products of the same order that are shipped for replacement in different

stages.

If all the above conditions are correctly fulfilled, once you have filled in and transmitted the Return Form containing

your request for an exchange, the Vendor will acknowledge your request by email.

After receiving the product(s) to be exchanged, the Vendor will inspect the product(s) to check that all the above

conditions have been fulfilled. If so, the Vendor will verify the actual availability of the replacement products in its

warehouses of the product(s) to ensure that the size and/or colour you have selected are available.

If the selected replacement product(s) are not available in the warehouse, the Vendor will not be able to accept your

request for an exchange and will refund you for the product(s) subject to and in accordance with sections 3 and 4

above.

If the selected product(s) are available in the warehouse, the Vendor will accept your request for an exchange and

will send you an e-mail confirming the shipment of the replacement product(s). Shipment will occur within thirty (30)

working days of the date from which the Vendor was made aware of your request for exchange. The costs for

shipping the replacement product(s) shall be borne by the Vendor.

When exchanging a product, if the price of the purchased product is lower or higher than the chosen replacement

product, you will not be granted a refund nor will you be required to pay the relative price difference. However, if you

choose to return the exchanged product in accordance with your legal rights, you will receive a full refund for the price

paid for the product.

You will be contacted by the Vendor if your request for an exchange cannot be accepted because the above

conditions have not been met. If so, the Vendor will refund you for the product(s) subject to and in accordance with

sections 3 and 4 above or (where a refund is not possible in accordance with the section 3 above) contact you to ask

whether you wish the product(s) to be returned to you at your expense. If you do not wish to have the product(s)

returned to you, the Vendor shall retain the product(s) and the amount paid for the purchase of the product(s).]

6 Identification Tag

We remind you that all products sold by the Vendor include an identification tag attached with a disposable seal

which is an integral part of the product. Please try on the products without removing the tag and seal. Products

returned without the tag and seal will not be accepted unless they are being returned by you in accordance with your

legal rights to reject a product (for example, because a product is faulty or not as described).
